Hold Harmless Waiver and Terms of Conditions

The participant of “Maleiyka” M. Mechler's online pole classes, in-person classes, online and in-person workshops, and online and in-person privates hereby assumes all risks associated with participation in any and all activities related to these events, including, by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the individuals or entities being released, from dangerous or defective equipment. The participant waives, releases, and discharges any and all liability, including but not limited to, liability arising from their own negligence or fault, for their death, disability, personal injury, or any actions of any kind that may occur during online pole classes, in-person classes, in-person workshops, and online and in-person privates by the following entities or persons: “Maleiyka” M. Mechler and/or their directors, employees, or volunteers. The participant agrees to indemnify, hold harmless, and promise not to sue the following entities or persons: “Maleiyka” M. Mechler and/or their directors, employees, or volunteers, from any and all liabilities or claims made as a result of participation in virtual pole dance classes or privates, whether caused by the negligence of those released or otherwise.

The participant acknowledges that “Maleiyka” M. Mechler and/or their directors, employees, or volunteers are not responsible for errors, omissions, acts, or failures to act of any party or entity conducting (virtual) pole dance classes or privates on their behalf. The participant acknowledges that this activity may involve injury. The risks include, but are not limited to, those caused by jumping, leaping, turning, stretching, inverting, lifting, or any pole dance/floor work movement, lack of hydration, improper pole dance/floor work, and actions of other people, including but not limited to, participants and/or producers of the activity.

The participant acknowledges that all online classes, online workshops, and in-person workshops and private sessions are non-refundable. They are subject to one (1) reschedule for any online classes, in-person classes, and in-person workshops free of charge. After one reschedule, the participant may be subject to a rescheduling fee. Classes and workshops have limited spaces, and many of them sell out. The participant can receive class or workshop credit if they cancel at least 48 hours before the scheduled class or workshop. To be eligible for class or workshop credit, the participant must ensure they cancel their registration at least 48 hours before the class or workshop start time. Cancellations made within 48 hours of the class or workshop start time are not eligible for class credit. If the participant does not communicate their cancellation and fails to attend, it will be considered a no-show, and they will not receive class or workshop credit.

The participant hereby consents to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during online pole classes, in-person classes, in-person workshops, and online and in-person privates.

The participant certifies that they have read this document and fully understand its content. They are aware that this is a release of liability and a contract, and by booking the class they sign it of their own free will. The participant certifies that they are physically fit, have sufficiently prepared or trained for participation in online pole classes, in-person classes, in-person workshops, and online and in-person privates, and have not been advised against participation by a qualified medical professional. They certify that there are no health-related reasons or problems that preclude their participation in online pole classes, in-person classes, in-person workshops, and online and in-person privates.

The participant acknowledges that this Accident Waiver and Release of Liability Form will be used by “Maleiyka” M. Mechler, directors, class holders, sponsors, and organizers of the activities in which they may participate, and that it will govern their actions and responsibilities at virtual pole dance classes/privates. They permit themselves to participate in in-person and virtual pole dance workshops, classes, and/or privates.
